Terms of Use
SWARM is a free game published by TJ NOVA LTD, a company registered in England and Wales under number 17308318. By installing or playing SWARM you agree to these terms.
Your licence
We grant you a personal, non-transferable, non-exclusive licence to install and play SWARM on devices you own or control. The game is free: there are no advertisements, no in-app purchases and no subscriptions. Coins earned in the game have no monetary value, cannot be bought, and cannot be exchanged for anything outside the game.
What you may not do
- Reverse engineer, decompile or modify the game except where that right cannot be excluded by law.
- Redistribute, resell, rent or republish the game or its assets as your own.
- Use the game in any way that is unlawful, or that interferes with other people's use of it.
Ownership
The game, its code, artwork, sound and name remain the property of TJ NOVA LTD. These terms give you no rights in our trade marks.
Your data
Your progress is stored only on your device. We cannot restore it if you delete the app, reset your progress, or switch to a new device. Please see the Privacy Policy for the full picture.
No warranty and liability
The game is provided as it is. We may change it, or stop offering it, at any time. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you is limited to the amount you paid for the game, which is nothing.
Apps distributed through the App Store
These terms are between you and TJ NOVA LTD only, not with Apple. Apple has no obligation to provide maintenance or support for SWARM. If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price, which is zero; to the maximum extent permitted by law Apple has no other warranty obligation. TJ NOVA LTD, not Apple, is responsible for addressing any claim relating to the app, including product liability, any failure to conform to legal requirements, and claims under consumer protection or privacy law, and for investigating and settling any third-party claim that the app infringes intellectual property rights. You confirm you are not located in a country subject to a United States Government embargo or designated as terrorist-supporting, and that you are not on any United States Government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you keep the protection of the mandatory law of your country of residence.
